Absence Limits for Standard Residence Permits (D7, D8, D1, D2)
Under Article 85 of Portugal's Foreigners Law (Lei n.º 23/2007), temporary residence permits may be revoked if the holder is absent from national territory without documented justification for:
- 6 Consecutive Months: Leaving Portugal continuously for more than half a year.
- 8 Non-Consecutive Months: Accumulating more than 8 months of total absence across the entire validity period of the card.
- Risk of Resetting the Clock: If AIMA cancels your permit due to unlawful absence, your 5-year naturalization countdown under Article 15(4) is interrupted.
The Golden Visa (ARI) Ultra-Low Presence Privilege
The Portuguese Golden Visa offers an exceptional statutory exemption from general immigration absence rules:
- Year 1: Only 7 physical days in Portugal.
- Years 2 & 3: 14 physical days combined across the 2-year renewal period.
- Years 4 & 5: 14 physical days combined.
- Total Over 5 Years: A mere 35 days in Portugal across 5 years grants complete compliance for Portuguese citizenship filing.
