The 3-Year Rule (Article 3 of the Nationality Law)
Foreign nationals married to Portuguese citizens are eligible to apply for Portuguese nationality through acquisition (aquisição de nacionalidade) under Article 3 of Lei n.º 37/81 once they have been married for **at least 3 continuous years**.
- No Minimum Stay: Unlike the 5-year naturalization path for visa holders, citizenship by marriage does not require physical residence on Portuguese soil. You can reside full-time in the UK, US, Brazil, or elsewhere.
- Mandatory Marriage Transcription: If the marriage took place outside Portugal, it must first be officially transcribed (transcrição de casamento) into the Portuguese Civil Registry before the nationality filing begins.
The Children in Common Exception (Article 9)
Historically, the Public Prosecutor (*Ministério Público*) could oppose marriage-based nationality filings by arguing that the foreign spouse lacked an 'effective connection to the national community' (*ligação efectiva à comunidade nacional*). Under recent legislative amendments:
- Statutory Shield: When the couple has common children who already hold Portuguese nationality, the law creates a conclusive presumption of connection, barring the prosecutor from challenging the file on connection grounds.
- Couples Without Common Children: If there are no common children, proof of basic Portuguese language knowledge (CIPLE A2 certificate) or evidence of community ties (property ownership, visits, social integration) is required.
De Facto Union (*União de Facto*): The Civil Court Procedure
Unmarried partners who have lived together in conditions analogous to spouses for at least 3 years can also apply under Article 3(2). However, unlike a legal marriage certificate, an *união de facto* must first be formally recognized through a declaratory court action before a Portuguese Family Court (*Tribunal de Família*) before the IRN will process the application.
